Terms of Sale
- Scope of application
- The purchase of products presented on our website ("STIMM.com"), managed by STIMM Srl, with registered office in vicolo del Bar, 1/a - 31020 San Vendemiano (TV), tax code and VAT number 04576520268 is governed by these General Conditions of Sale ("GCS").
- The GTC apply to anyone who places a purchase order through STIMM.com (the "Customers"), with the exception of the provisions that refer to the provisions of articles 50 to 63 of Legislative Decree no. 206/2005, applicable exclusively to natural persons who purchase the products for purposes other than their business or professional activity (the "Consumer Customers"); it is presumed that a Customer who sends a purchase proposal by entering his/her VAT number in the area relating to the Customer's personal data is not a Consumer Customer.
- These GTC apply to every Order placed and forwarded to STIMM through STIMM.com (the “Order”) and to every contract that is subsequently concluded in accordance with the methods set out in Section 3 (the “Contract”).
- These GTC are an integral part of the purchase contract for any Product, therefore, by placing an Order, the Customer accepts them.
- STIMM may modify the content of these GTC at any time; the modifications will become an integral part of the new Contracts starting from the first Order sent by the Customers after their publication on the Site. The previous version of the GTC will be applied to Orders already sent after the publication of the modifications on the site.
- The products on sale on the STIMM.com website are intended exclusively for end users of the products purchased and not for individuals who intend to resell the products purchased on the website; STIMM may check at any time whether customers are acting as resellers and, in this case, cancel the contracts that have been concluded with them.

- The Customer can print and/or save a copy of the GTC and of the documents that make up the Contract relating to the Products purchased on the Site, using the normal functions of their browser (e.g.: “File” –> “Save as”), or download it in PDF format and archive it by clicking [HERE].
- The Customer may archive the data of his/her Order, either by downloading the GTC and saving the data summarised on the last web page preceding the forwarding of each Order, or by saving the emails that STIMM will subsequently send to the Customer, which will contain the data of the Order.
- Conclusion of the Contract
- The presentation of the products on the Site constitutes an invitation to the users of the Site to view our products and possibly make a purchase.
- To proceed with the purchase of one or more Products via the Internet, it is not necessary to register on STIMM.com, but it is necessary to provide STIMM with the essential data to allow the completion of the Orders placed, in compliance with the provisions regarding the protection of personal data.
- The Customer will be able to select the product or products he wishes to purchase and place them in the virtual "cart", the contents of which he will always be able to view.
- By clicking on the "Proceed to purchase" button, you start the Order forwarding procedure. During the Order formulation phase and until its actual forwarding, it will be possible to review the data entered by clicking on the "Back" button, in order to identify and correct any errors.
- By clicking on the "Complete Order" button, at the end of the procedure, the Customer forwards the Order. Each Order forwarded following the methods previously described will be considered, for all purposes, a contractual proposal by the Customer.
- The availability of the Products indicated on the site may not be updated in real time and, in the event that there are numerous simultaneous accesses, the actual availability of the individual Products may vary significantly during the day. Before confirming an Order, STIMM reserves the right to verify the actual availability of the Products subject to the Order. STIMM may decide to confirm or not the Orders received without, in the event of failure to confirm, the Customer being able to advance rights or claims against STIMM for any reason. In any case, STIMM will not accept Orders that provide for delivery in the municipalities of Livigno and Campione d'Italia
- The Order will be considered accepted and the Contract will be considered concluded only when the Customer receives, at his/her email address, express confirmation of shipment of the Order (the “Shipping Confirmation”).
- Price and shipping costs
- The prices of the Products published on the homepage or in the various sections of the Site are expressed in euros and include VAT.
- ITALY: Shipping is free for orders over €130. For orders under €130, shipping costs will be indicated before proceeding with payment. In the event of unavailability of the product to reach the threshold necessary for free shipping, STIMM will not charge shipping costs.
ABROAD: Shipments are always subject to charges and vary according to the place of delivery, weight, quantity and size of the packages. - STIMM reserves the right to change the prices of the Products listed on the Site at any time. Any changes to the prices of Products will not affect orders already placed. In the event of a recognizable error in the price of a product listed on the Site (or clearly disproportionate to the value of the item), STIMM reserves the right to not accept and cancel the Order placed by the Customer.
- Payment and delivery

The Customer must use one of the payment methods proposed by STIMM during the Order submission process on STIMM.com.
The different payment methods are: payment by credit card, payment via the protected “Paypal” system and bank transfer. -
The Customer will pay the full price of the Products ordered at the time of placing the Order.
If the Order is not accepted, STIMM will refund Customers any amounts already paid. - The payment document or tax document will be issued in electronic format. The invoice, if necessary, must be requested when completing the Order, by writing an email to customerservice@STIMM.com specifying the billing data.
- STIMM will ship the ordered Products via courier within 5 (five) working days from the date of the Order or, in the case of payment by bank transfer, from the credit to STIMM. At the time of shipment STIMM will communicate to the Customers the data that will allow them to verify the status.
- STIMM will not be responsible for failure or delay in delivery due to force majeure (such as strikes, measures by public authorities, transport difficulties, fires, floods, etc.).
- STIMM will promptly notify the Customer of the occurrence and cessation of a cause of force majeure. If the cause of force majeure persists for a period exceeding 30 days, each party will have the right to withdraw from the contract.
- In the event of withdrawal, the Customer will not be entitled to any compensation or reimbursement of any kind, but will be refunded any amount already paid as the price for the Product which is the subject of the Order, within 30 (thirty) days of sending the Order.
- STIMM is responsible for the products until their delivery to the Customer, regardless of whether the shipment of the Products is insured or not.
- Before accepting the Products from the courier, at the time of delivery, the Customer is required to carefully inspect the package. The packages are sealed with personalized “STIMM” adhesive tape, placed around the package. If the package appears tampered with or if the adhesive tape is not intact, the Customer must note this on the receipt of the Products that he releases to the courier or can refuse delivery and contact STIMM at the email address customerservice@STIMM.com within the following two working days, to allow STIMM to take action against the courier. If the Customer accepts tampered packages without notifying the courier, STIMM is not liable for damage or shortages relating to the delivered Products.
- Right of withdrawal
- Pursuant to art. 52 et seq. of the Consumer Code, the consumer is granted the right of withdrawal, that is, to withdraw from the contract stipulated without having to provide any explanation and without penalty, within 14 (fourteen) calendar days from the date of delivery of the item. This right of withdrawal may be exercised by sending a written communication, containing the specification of the products to be returned, to the email address resi@STIMM.com.
- In case of exercising the right of withdrawal, the consumer Customer must return the Product at his own expense to STIMM within the same period of 14 (fourteen) days from the date of delivery of the item, to the following address:

Italy - Shipping costs related to the return of the Products for the exercise of the right of withdrawal are always borne by the customer both for Italy and abroad.

The consumer Customer who intends to exercise the right of withdrawal must return the products:
- properly packaged in their original packaging, in perfect resalable condition (not ruined, damaged or soiled) and equipped with all accessories, instructions for use and documentation;
- without obvious signs of use, other than those compatible with carrying out a normal test of the item and must not be in such a condition as to not allow resale.
If the returned Products do not comply with the characteristics described, the withdrawal will not be effective. - If the right of withdrawal has been exercised following the methods and terms indicated above, STIMM will refund the relative price paid within 14 (fourteen) days from the date on which STIMM received the communication of exercise of the withdrawal or, if earlier, from the date on which it received the returned Product. Otherwise STIMM will recall the purchased item, charging the Customer for transport costs and any storage costs.
- Returns and Refunds
- It is always possible to make a return if the purchase has not satisfied the Customer's needs. The return can be exercised within 14 (fourteen) days from the date of delivery of the item.
- It is necessary to complete and attach the appropriate return form ( link ) indicating the reason for the return, the items returned, and the shipping preference.

The Customer who intends to make a return must return the products:
- properly packaged in their original packaging, in perfect resalable condition (not ruined, damaged or soiled) and equipped with all accessories, instructions for use and documentation;

If the returned Products do not comply with the characteristics described, the return will not be effective. - If the return has been exercised following the methods and terms indicated above, STIMM will refund the relative price paid within 14 (fourteen) days from the date on which STIMM received the returned Product.
- Shipping costs related to the return of the Products are free from Italy, for orders with an initial total value greater than €130. Shipping costs abroad for the shipment of the Products are always paid by the customer, who must use his own shipping agent.
- Shipping costs related to any postal storage will always be borne by the Customer. In any case, the risks associated with the destruction or damage of the Products returned during shipping are borne by the Customer.
- Warranty and Complaints Management
- The provisions of the law regarding guarantees apply to purchases made by consumer customers, including those provided for by the Consumer Code for consumers.
- If the products are defective or altered, the Customer may contact STIMM according to the methods indicated in these GTC and request their repair or replacement. The choice between repair or replacement is entrusted to the Customer, unless the chosen remedy is objectively impossible or excessively expensive compared to the other. The complaint by the consumer Customer must be made within two months of discovery and, in any case, within twenty-six months of delivery of the Products, under penalty of forfeiture.
- STIMM will, as appropriate, carry out the requested repairs and replacements within a reasonable time from receipt of the Customer's request. The Customer must describe in as much detail as possible the nature of the defect or alteration found and send a copy of the Order documents or indicate the Order number, the Customer number, and the data useful for identifying the complaint. If no response is received by the Customer within 5 (five) working days, the Customer is invited to request a response.

If (i) the requested repair or replacement is impossible or excessively expensive, (ii) has not occurred within an appropriate timeframe; or (iii) has caused significant inconvenience to the Customer, the latter may request, at his/her discretion, an appropriate reduction in the price or the termination of the Contract. Termination of the Contract is not permitted for products that have minor defects, which are impossible or excessively expensive to repair or replace.
- Data Protection
- STIMM reserves the right to store the data of each Order and the Customer's contact details. This information will be used only to allow the correct execution of the Order (also through transmission to third parties involved in the management of the payment, in the execution of the Order and/or in the shipment of the item), of any complaints regarding the warranty of the item and/or recommendations or instructions to the Customer relating to the item. The storage and processing of data will take place in accordance with the content of the privacy policy on the protection and use of personal data by STIMM.
- The Customer may access this confidential information only after logging into the reserved area of the Site called “My Account”, by entering the access credentials that were assigned to him/her at the time of registration on the Site.
- The Customer will have the right to place the Order even without registering on the site and in this case only the data necessary for the purchase and shipping of the Order will be collected by STIMM. Furthermore, in this case, the Customer will not be able to see the history of his purchases as he has not created the account. Registration can take place either after the Customer has placed the Order or regardless of any purchase. Once the Customer has accessed the reserved area, he will be able to consult the Contracts already concluded, the pending Orders, update and save his contact details, any bank details and/or data relating to the subscription to the newsletter service. The Customer undertakes to treat his access credentials to the aforementioned reserved area of the Site in a confidential manner and not to make them available to third parties.
- Applicable law and disputes
- The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005, on the consumer code in Chapter I "Consumer rights in contracts", with specific reference to the legislation on distance contracts and by Legislative Decree no. 70 of 9 April 2003 on certain aspects concerning electronic commerce.
- Please be informed that the European Commission provides a platform for alternative extrajudicial resolution of disputes, accessible on the website http://ec.europa.eu/odr .
