Terms of Sale
Scope of application
- The purchase of products presented on our website ("STIMM.com"), managed by STIMM Srl, with registered office in vicolo del Bar, 1/a - 31020 San Vendemiano (TV), tax code and VAT number 04576520268 is governed by these General Conditions of Sale ("GTC").
- The GTC apply to anyone placing a purchase order through STIMM.com (the "Customers"), with the exception of the provisions that refer to the provisions of Articles 50 to 63 of Legislative Decree no. 206/2005, which apply exclusively to natural persons purchasing the products for purposes unrelated to any business or professional activity they may carry out (the "Consumer Customers"); a Customer who submits a purchase proposal by entering their VAT number in the Customer's personal data area is presumed not to be a Consumer Customer.
- These GTC apply to every Order placed and forwarded to STIMM through STIMM.com (the “Order”) and to every contract that is subsequently concluded in accordance with the methods set out in Section 3 (the “Contract”).
- These GTC are an integral part of the purchase contract for any Product, therefore, by placing an Order, the Customer accepts them.
- STIMM may modify the content of these GTC at any time. The modifications will become an integral part of the new Contracts starting from the first Order placed by Customers following their publication on the Site. The previous version of the GTC will apply to Orders already placed after the modifications are published on the site.
- The products for sale on the STIMM.com website are intended exclusively for end users of the purchased products and not for individuals intending to resell the products purchased on the site. STIMM may verify at any time whether customers are acting as resellers and, if so, cancel any contracts concluded with them.
- Download and view the terms and conditions of the Contract
- The Customer can print and/or save a copy of the GTC and of the documents that make up the Contract relating to the Products purchased on the Site, using the normal functions of their browser (e.g.: “File” –> “Save as”), or download it in PDF format and archive it by clicking [HERE].
- The Customer may archive the data of his/her Order, either by downloading the GTC and saving the data summarised on the last web page preceding the submission of each Order, or by saving the emails that STIMM will subsequently send to the Customer, which will contain the Order data.
- Conclusion of the Contract
- The presentation of the products on the Site constitutes an invitation to users of the Site to view our products and, if necessary, make a purchase.
- To purchase one or more Products online, you do not need to register on STIMM.com, but you must provide STIMM with the necessary information to complete the Orders you have placed, in compliance with the provisions regarding the protection of personal data.
- The Customer will be able to select the product or products he wishes to purchase and place them in the virtual "cart", the contents of which he will always be able to view.
- By clicking the "Proceed to Checkout" button, you begin the Order process. During the Order process and until it is actually submitted, you can review the information you entered by clicking the "Back" button to identify and correct any errors.
- By clicking the "Complete Order" button at the end of the process, the Customer submits the Order. Each Order submitted following the methods described above will be considered, for all purposes, a contractual proposal by the Customer.
- Product availability indicated on the site may not be updated in real time, and in the event of numerous simultaneous visits, actual availability of individual Products may vary significantly throughout the day. Before confirming an Order, STIMM reserves the right to verify the actual availability of the Products in the Order. STIMM may decide whether or not to confirm Orders received, without the Customer being entitled to any rights or claims against STIMM in the event of failure to confirm. In any case, STIMM will not accept Orders for delivery to the municipalities of Livigno and Campione d'Italia.
- The Order will be deemed accepted and the Contract will be deemed concluded only when the Customer receives, at his/her email address, express confirmation of shipment of the Order (the “Shipping Confirmation”).
- Price and shipping costs
- The prices of the Products published on the homepage or in the various sections of the Site are expressed in euros and include VAT.
- ITALY: Shipping is free for orders over €130. For orders under €130, shipping costs will be indicated before payment. If the product is not available to meet the free shipping threshold, STIMM will waive shipping costs.
INTERNATIONAL: Shipping costs are always subject to charges and vary depending on the delivery location, weight, quantity, and size of the packages. - STIMM reserves the right to change the prices of the Products listed on the Site at any time. Any changes to Product prices will not affect orders already placed. In the event of a recognizable error in the price of a product listed on the Site (or one that is clearly disproportionate to the value of the item), STIMM reserves the right to refuse and cancel the Order placed by the Customer.
- Payment and delivery

The Customer must use one of the payment methods offered by STIMM during the Order submission process on STIMM.com.
The various payment methods are: credit card payment, payment via the secure "Paypal" system, and bank transfer. -
The Customer will pay the full price of the Products ordered at the time of placing the Order.
If the Order is not accepted, STIMM will refund Customers any amounts already paid. - The payment document or tax document will be issued in electronic format. An invoice, if required, must be requested when completing the Order by sending an email to customerservice@STIMM.com specifying your billing information.
- STIMM will ship the ordered Products via courier within 5 (five) business days from the date of the Order or, in the case of payment by bank transfer, from the date the payment is credited to STIMM. Upon shipment, STIMM will provide Customers with the information necessary to verify the status of the Products.
- STIMM will not be responsible for failed or delayed delivery due to force majeure (such as strikes, public authority measures, transportation difficulties, fires, floods, etc.).
- STIMM will promptly notify the Customer of the occurrence and cessation of a cause of force majeure. If the cause of force majeure persists for a period exceeding 30 days, either party will have the right to withdraw from the contract.
- In the event of withdrawal, the Customer will not be entitled to any compensation or reimbursement of any kind, but will be refunded any amount already paid as the price for the Product subject to the Order, within 30 (thirty) days of sending the Order.
- STIMM is responsible for the products until their delivery to the Customer, regardless of whether the shipment of the Products is insured or not.
- Before accepting the Products from the courier upon delivery, the Customer is required to carefully inspect the packaging. The packages are sealed with personalized "STIMM" tape, placed around the package. If the package appears tampered with or if the tape is damaged, the Customer must note this on the Product receipt issued to the courier or may refuse delivery and contact STIMM at customerservice@STIMM.com within two business days to allow STIMM to take action against the courier. If the Customer accepts tampered packages without notifying the courier, STIMM is not responsible for any damage or shortages to the delivered Products.
- Right of withdrawal
- Pursuant to Articles 52 et seq. of the Consumer Code , the consumer has the right to withdraw from the contract without providing any explanation and without penalty, within 14 (fourteen) calendar days from the date of delivery of the item. This right of withdrawal may be exercised by sending a written communication specifying the products to be returned to resi@STIMM.com.
- In case of exercising the right of withdrawal, the consumer Customer must return the Product at his own expense to STIMM within the same period of 14 (fourteen) days from the date of delivery of the item, to the following address:

Italy - Shipping costs associated with returning Products to exercise the right of withdrawal are always borne by the customer, both for Italy and abroad.

The consumer customer who intends to exercise the right of withdrawal must return the products:
- properly packaged in their original packaging, in perfect resalable condition (not ruined, damaged or soiled) and equipped with all accessories, instructions for use and documentation;
- without obvious signs of use, other than those compatible with carrying out a normal test of the item and must not be in such a condition as to prevent resale.
If the returned Products do not comply with the characteristics described, the withdrawal will not be effective. - If the right of withdrawal has been exercised according to the methods and terms indicated above, STIMM will refund the price paid within 14 (fourteen) days from the date on which STIMM received the notification of the exercise of the right of withdrawal or, if earlier, from the date on which it received the returned Product. Otherwise, STIMM will recall the purchased item, charging the Customer the transport costs and any storage costs.
- Returns and Refunds
- You can always return an item if it doesn't meet your expectations. Returns can be made within 14 (fourteen) days of the item's delivery date.
- It is necessary to complete and attach the appropriate return form ( link ) indicating the reason for the return, the items returned, and the shipping preference.

The Customer who intends to make a return must return the products:
- properly packaged in their original packaging, in perfect resalable condition (not ruined, damaged or soiled) and equipped with all accessories, instructions for use and documentation;
- without obvious signs of use, other than those compatible with carrying out a normal test of the item and must not be in such a condition as to prevent resale.
If the returned Products do not comply with the characteristics described, the return will not be effective. - If the return has been exercised following the methods and terms indicated above, STIMM will refund the relevant price paid within 14 (fourteen) days from the date on which STIMM received the returned Product.
- Shipping costs for returning Products are free from Italy for orders with an initial total value of more than €130. Shipping costs abroad for shipping Products are always the responsibility of the customer, who must use their own shipping provider.
- Shipping costs associated with any postal storage will always be borne by the Customer. In any case, the risks associated with the destruction or damage of returned Products during shipment are borne by the Customer.
- Warranty and Complaints Management
- Purchases made by consumer customers are subject to legal warranty provisions, including those provided for by the Consumer Code for consumers.
- If the products are defective or altered, the Customer may contact STIMM according to the procedures indicated in these GTC and request repair or replacement. The choice between repair or replacement is up to the Customer, unless the chosen remedy is objectively impossible or excessively costly compared to the other. The complaint by the consumer Customer must be made within two months of discovery and, in any case, within twenty-six months of delivery of the Products, under penalty of forfeiture.
- STIMM will, as applicable, carry out the requested repairs and replacements within a reasonable timeframe from receiving the Customer's request. The Customer must describe the nature of the defect or alteration found in as much detail as possible and send a copy of the Order documents or indicate the Order number, Customer number, and any information needed to identify the complaint. If the Customer does not receive a response within 5 (five) business days, the Customer is invited to request a response.

If (i) the requested repair or replacement is impossible or excessively costly, (ii) is not completed within an appropriate timeframe, or (iii) has caused significant inconvenience to the Customer, the Customer may, at his or her discretion, request an appropriate price reduction or termination of the Contract. Termination of the Contract is not permitted for products with minor defects that are impossible or excessively costly to repair or replace.
- Data protection
- STIMM reserves the right to retain the data for each Order and the Customer's contact information. This information will be used only to enable the proper fulfillment of the Order (including through transmission to third parties involved in managing the payment, fulfilling the Order, and/or shipping the item), to handle any complaints regarding the item's warranty, and/or to provide recommendations or instructions to the Customer regarding the item. Data storage and processing will be conducted in accordance with the privacy policy on the protection and use of personal data by STIMM.
- The Customer will be able to access this confidential information only after logging into the reserved area of the Site called "My Account", entering the login credentials assigned to him/her when registering on the Site.
- The Customer may place an Order even without registering on the site, and in this case, STIMM will only collect the data necessary for purchasing and shipping the Order. Furthermore, in this case, the Customer will not be able to view their purchase history since they have not created an account. Registration can occur either after the Customer has placed the Order or independently of any purchase. Once logged in to the reserved area, the Customer will be able to view completed Contracts, pending Orders, update and save their contact details, any bank details, and/or data relating to subscription to the newsletter service. The Customer agrees to treat their login credentials for the aforementioned reserved area of the Site as confidential and not to make them available to third parties.
- Applicable law and disputes
- The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005 on the Consumer Code, Chapter I "Consumer Rights in Contracts", with specific reference to the legislation on distance contracts, and by Legislative Decree no. 70 of 9 April 2003 on certain aspects concerning electronic commerce.

- Gift Card

The Gift Card is a gift voucher that can be purchased online by accessing the website www.stimm.com and can be used for personal purchases or as a gift to a third party.
During the purchase process, the Buyer must provide their personal details, those of the recipient, and a valid email address for the Beneficiary to send the Gift Card. It is the Buyer's responsibility to ensure that the email address is correct; the Seller cannot be held liable for any errors.
Gift Cards can be purchased using any payment method available on the Site. Refunds will only be available if the Gift Card has not been used and will be processed using the same payment method used for the purchase.
Once the purchase procedure is completed, an email containing the gift voucher code will be sent to the recipient indicated by the Buyer at the time of purchase.
The Gift Card will be immediately usable for the purchase of products available on the Site, without the need for further activation.
To redeem the Gift Card, the recipient must enter the code received via email in the "Discount Code" field at checkout. The value will be automatically deducted from the order total. It is not possible to use more than one Gift Card per order.
The Gift Card can be used multiple times until its value is exhausted and in any case within 365 days from the date of issue. After each purchase, the Gift Card's balance will be automatically deducted until it's completely used up. If the remaining balance on the Gift Card isn't sufficient to cover the entire order amount, the remaining balance can be paid using the payment methods available on the Site.
Once the validity period has expired, the Gift Card can no longer be used and any residual value will not be refundable.
Stimm.com reserves the right to refuse orders placed with duplicate or fraudulently obtained Gift Cards.Any communications and/or complaints regarding the use of the Gift Card can be forwarded to Customer Service by email at customerservice@stimm.com or by telephone at 0438 412 334.
